2009-05-29: Update on SAMWU industrial action: It is still illegal

THE on-going industrial action by the South African Municipal Workers Union (SAMWU) affiliated Johannesburg Emergency Management Services staff is illegal.

SAMWU, as an organized labour movement, is aware of the correct structures and channels to be followed whenever there is an issue to be discussed and/or negotiated. There have been formal engagements and/or meetings between management and organized labour representatives on the career development framework. This is, and has been an on-going process that has throughout, involved organized labour.

The matter in question (salary progression) is on the agenda of the South African Local Government Bargaining Council (SALGBC) currently sitting in Durban, Kwa-Zulu Natal and as a City, we are eagerly awaiting its outcome as well. At a regional level, SAMWU has already agreed to engage further on the same issue. A meeting has been scheduled for next Friday, 05 June 2009.

It should be emphasized that at no point did EMS Management agree or were party to an agreement for any salary negotiations or promises of such, outside the formal structure of the SALGBC.

Although the members have the right to take part in any industrial action (strike), such action should be legal in terms of the applicable labour relations Act. EMS Management condemns any form of intimidation, violence and harassment of those who chooses not to take part in the ongoing illegal/unprotected industrial action.

It is an undisputable fact that actions by these individuals who have malicious intent to disrupt service delivery, will threaten the safety and lives of innocent people. Contingency plans have been put in place to deal with any disruptions to service delivery that might compromise the safety and/or lives of the City's residents.

We would like to reiterate that this action is illegal and unprotected.
