2010-06-18: City welcomes Constitutional Court judgement
THE Constitutional Court's judgement, confirming the City of Johannesburg's power to take decisions regarding land use, has brought much-needed certainty on an important issue.
"The City welcomes the Court's judgement. It confirms that the City has the powers to take the decisions on applications for the establishment of townships and amendments to town-planning schemes," says Nthatisi Modingoane, Deputy Director for Communications in the City of Johannesburg.
The Constitutional Court upheld an earlier decision by the Supreme Court of Appeals on the question of who was empowered by the Constitution to control and manage land use in a municipal area.
The dispute arose when some developers failed to comply with the City's regulations relating to applications for re-zoning and township establishments.
Modingoane says Constitutional Court's decision will provide administrative certainty and clear guidelines for all stakeholders involved in the town planning process.
