08-11-2012: City's response to SAPOA judgement

 
The City has noted the Judgment of the Supreme Court of Appeal on the matter involving the South African Property Owners Association (SAPOA).

 
The Judgment deals with the City’s imposition of rates on comm​ercial properties during the 2009/2010 year when the City was facing numerous challenges with the then new Municipal Property Rates Act (MPRA) and the new Valuation Roll.

 
The public participation procedures followed by the City in setting its rates tariffs at the time, have been found to be inadequate by the court. The Court accordingly made declaratory orders specifying the City’s obligations in future should it contemplate materially amending its proposed budget after it has been advertised. The City acknowledges the Judgment and the clarity given in relation to the City’s rate tariff setting processes.

 
The City continues to update its valuation records in line with its ongoing commitment to improve its revenue stream and relationship with its customers. The Judgment has not affected the City’s 2009/2010 budget and, in the circumstances, the resources of the City remain available and committed to ongoing service delivery.

 
In line with the Judgment of the Supreme Court of Appeal and the Joburg Growth and Development Strategy 2040, the City will continue to enhance its community and stakeholder engagement processes.
