Joburg obtain interdict against the Alleluia Ministries International
The Member of the Mayoral Committee responsible for Development Planning in the City of Johannesburg, Clr Roslynn Greeff, announced that the City obtained an interim court interdict to prevent the Alleluia Ministries in Lyndhurst, from continuing the illegal building activities as well as holding services on the site.
This comes after a section of the church`s wall collapsed last week.
Councillor Greeff further stated that the Alleluia Ministries had been issued with two orders by the City to stop building illegally.
“It is unfortunate that the Church chose to ignore these notices and continued with construction,” said MMC Greeff.
The church has no approved plans and does not have permission to be operating as a place of worship.
The City had already commenced with a legal process to stop all illegal activities on site. The collapse last week prompted the City to approach the Court on an urgent basis. An interim interdict was granted to the City on Friday 10 October 2014.
According to the interim order “The respondent is interdicted and restrained from continuing, causing or permitting in any way, further construction, building or erection of any illegal buildings (being a church and ancillary building) on a property described as Erven 81 &82 Whitney Gardens Ext 16 in Lynhurst, Johannesburg.”
The church is further interdicted from permitting the use or occupation of the illegal buildings by any workers or any other person until such time that an occupational certificate for the use and occupation of the buildings is issued and an engineering report which certifies that the buildings are stable and structurally safe for use and occupation is submitted to the City.
The church is expected to appear again before that Court on Thursday, 16 October 2014 to convince the Court why a final order should not be issued in this matter.
