With only 2 days to go for lodging an objection with the City of Johannesburg, we wish to remind property owners to view and, if required, lodge an objection by this Friday, 6 April 2018 at 15:00.

It is important to note that there are only 2 ways to lodge an objection with the City:

1) This can either be done at one of the 12 assigned walk-in venues city wide;
The assigned walk-in venues listed below, should be used to ensure that property owners receive a system generated acknowledgement form to validate their objection. Property owners will be assisted by professional valuers to complete the objection form after which the objection will be captured at the venue and an official acknowledgement form, with an official objection number, validating the objection submission will be received by the objector.

2) Online on the City’s website www.joburg.org.za. 
For online objections, property owners will be able to log onto the City’s website www.joburg.org.za and lodge their objection. An official acknowledgement form, with an official objection number will be emailed to the objector validating the objection. Without an acknowledgement confirmation letter, the submission will not be considered valid.

No objection via the Call Centre, email or facsimile (fax) will be accepted. Furthermore, no late objections (after the closing date of 6 April 2018) will be accepted.

Remember to include the reason for your objection, along with evidence to support your objection.  Examples of this could be to:
•    Get a professional Valuer to value your property, and submit the valuation report along with your objection;
•    Speak to an estate agent about properties in your neighborhood that have sold around 1 July 2017 that are similar to your property; 
•    Add any other information that you think will influence your property, either in a good way or in a bad way, for instance, crime, the condition of your building, if it is located on a busy street, etc.  

An objection must be in relation to a specific individual property and not against the Valuation Roll as such. The Municipal Manager must after the end of the inspection period submit all objections to the Municipal Valuer within 14 days after the end of the objection period.

A separate objection form must be completed for each property (i.e. one objection form per objection needs to be submitted).

What you MAY object to:
•    Omission (property not found or other information omitted);
•    Incorrect information (address, owner, property, unit number, etc.);
•    Incorrect value/market value (too high/low);
•    Other owners’ property information;
•    The registered or other description of the property and category of the property.

What you MAY NOT object to:
•    You MAY NOT object on the grounds that you are a pensioner or similar reasons – only reasons related to the property;
•    You MAY NOT object on the grounds that you never intended “selling the property” or that “the property does not have a market value”;
•    Consumption related queries do not constitute grounds for objection as it is not part of the valuation process.

Once a decision has been made, written confirmation will be send to property owners. 
Objectors are entitled to appeal against the decision of the Municipal Valuer should they be able to prove valid grounds on which to base the appeal. They must adhere to the timeframes for the appeal process. The Valuation Appeal Board, an independent body appointed by the MEC for Local Government under Section 56 of the MPRA, as amended, can confirm, amend or revoke the decision of the Municipal Valuer.

A Section 49 notice is a notice that property owners receive once the valuation roll has been finalised and handed over the City Manager.  Section 49 notices were sent to all property owners where the City had addresses during the month of February and March. The City then allows property owners to lodge an objection on the valuation roll. It is important to note that property owners can’t request a review via a Section 78 if they have not received a Section 49 notice. 

A Section 78 notice is sent to property owners where the City had revalued the property for reasons as stated in section 78(1) of the Municipal Property Rates Act. A section 78 that notice supersedes a Section 49 notice. A section 78 notice allows the owner to request the City to review the valuation it is NOT to object.  The Municipal Valuer will review the information on the property as well as the information received.  The outcome thereof will be communicated to the owner.   

The next step is then to follow the objection and appeal processes but only when the Supplementary Roll is produced.

The Valuation Roll will be available for inspection by members of the public at the following 12 stations around Joburg, from 20 February until 6 April 2018:
