On 23 February 2023, the Johannesburg Metropolitan Council voted to approve the recommendation to appoint Mr Floyd Brink as the City Manager.
This resolution is as per the outcomes of a recruitment process and Interview and Selection Panel that was chaired by the former Mayor of the City, Cllr Phalatse (DA) with the participations of Cllrs Knott (DA), Ngobeni (ActionSA) and Harris (ACDP) on 16 February 2022.
The panel made a clear recommendation that should the 1st preferred candidate for whatever reason not be available to take up the position, the 2nd preferred candidate, in this case Mr Brink, must be engaged and processes followed to appoint him as City Manager.
On 22 February 2023, Council rescinded the decision to readvertise the position of the City Manager which was illegally obtained by Cllr Phalatse and Cllr Knott on 05 August 2022 and that rendered null and void any decision that would have resulted from such a recruitment process.
That Mr Brink qualifies for the position of City Manager is not in question and that is why the DA-led multiparty coalition government, through the Interview and Selection Panel it constituted identified him as the second preferred of the two candidates to be recommended for appointment by Council.
Furthermore, COGTA regulations in Section 1 of Annexure B to the Regulations on the Appointment and Conditions of Employment of Senior Managers defines senior management levels and Regulation 1 B.1 (a) of Chapter 4 of the Public Service Regulations defines the Senior Management Service.
Furthermore, COGTA regulations in Section 2 of Annexure B to the Regulations on Appointment and Conditions of Employment of Senior Managers states that the mandated experience for someone to be employed as a municipal manager is “five (5) years’ experience at middle management level.”
Prior to Mr Brink being employed as the COO (on a four-year contract) of the City of Johannesburg in August 2018, a position he held until July 2022, he was employed in the Limpopo Department of Transport as a Chief Director from March 2011 to July 2018 (7 years) and was before that a Director from November 2007 to February 2011 (3 years).
As a matter of fact, in the recruitment and interview and selection panel report that was chaired by Cllr Phalatse, the Panel stated, in support of its recommendation of Mr Brink as the 2nd preferred candidate for the role of City Manager, that “the candidate has over seventeen (17) years of working experience of which fourteen (14) years are at a senior management level.”
The above assessment by the Interview and Selection Panel means Mr Brink not only met the requirements and did so exceedingly.
The decision to appoint Mr Brink and subsequently the decision to rescind second re-advertisement of the position is a Council resolution.
“As the Member of the Mayoral Committee responsible for Group Corporate and Shared Services, I have a responsibility to implement Council resolutions failing which, we would be in contempt of council and going against the oath of office we took to serve and abide by the decisions of Council and laws of the Republic,” said Cllr. Loyiso Masuku.
“The Democratic Alliance’s (DA) posture on the matter is aimed at further rendering the City dysfunctional through covert means and media sensationalism aimed at collapsing governance and service-delivery in the City” concluded MMC Masuku.
